Community Rules
0.1 — Purpose
This document governs all participation in the State of Montaro community.
It applies to Discord, the website, social media, and the FiveM game server.
It defines expectations, standards, rights, and protections for all players, staff, and administrators.
0.2 — Authority
All enforcement and interpretation of these rules fall under the National Investigation Agency (NIA).
The NIA represents both the administrative staff and the lore body responsible for oversight.
0.3 — Legal Disclaimer
By joining or participating in the State of Montaro, you acknowledge that:
• Participation is voluntary.
• The experience is fictional and for creative entertainment.
• You waive any right to ownership or compensation related to in-city content, recordings, or stories.
Golden Rule: You can always earn more pixel money. None of us can earn more time.
Respect each other’s time, art, and process.Article 1.1 — Core Terms
Community
All official digital spaces operated under the State of Montaro.
City
The FiveM game server representing the fictional State of Montaro.
OOC (Out-of-Character)
Any real-world communication or action outside of roleplay.
IC (In-Character)
Behavior, dialogue, or decisions performed as a fictional character.
NIA
The administrative and lore body that governs rules, economy, enforcement, and oversight.
ERP
Any sexual or sexually suggestive content. Prohibited entirely.
RMT
Any exchange of real-world currency or value for in-game benefit.
Exploit
Use of a bug, glitch, or unintended mechanic for advantage.
Metagaming
Using OOC information to gain IC advantage.
Powergaming
Forcing an outcome on another player without fair chance to respond.
NLR (New Life Rule)
A character may not remember events leading up to their death or incapacitation.
Warning
A written notice of violation, not accompanied by suspension.
Amendment
A formally logged modification to this document.
2.1 — Age Requirement
All participants must be 18+.
Participation from players 25+ is preferred due to the mature tone of the world.
2.2 — Voluntary Participation
Participation does not create employment, partnership, or financial relationship of any kind.
2.3 — Recording Consent
By joining, you grant the project a perpetual, worldwide, royalty-free license to record, stream, publish, and adapt your gameplay, voice, and text for storytelling or promotional use.
3.1 — Observation
Administrators may monitor gameplay and Discord activity to ensure compliance and safety.
3.2 — Privacy Protection
No sharing or requesting of real-world personal information is allowed.
Doxxing results in immediate permanent removal.
3.3 — DM Conduct
Harassment, threats, or unwanted messages in private DMs count as community violations.
3.4 — ERP Prohibited
No erotic, sexual, or suggestive RP of any kind is allowed on any platform.
3.5 — Harassment
Any repeated or targeted behavior meant to intimidate, demean, or harm another player or staff member.
4.1 — RMT Prohibition
No real-world currency, crypto, or value may be used for in-game items, assets, or services.
This includes:
• Selling in-game items for cash
• Selling access or queue priority
• Selling services that affect gameplay
4.2 — Enforcement
RMT violations result in immediate permanent bans.
All logs and evidence may be preserved and provided to relevant authorities if required.5.1 — Immersion
No breaking character in-city.
OOC may only occur when summoned to NIA Headquarters.
5.2 — Story Integrity
Winning is irrelevant.
Character loss, failure, and evolution are part of the cinematic world.
5.3 — Player Time
Respect the time and energy of others.
Pixel money can be replaced; real time cannot.
5.4 — Economy
Admins may rebalance wealth, conduct audits, or remove items to preserve fairness and lore stability.
6.1 — IC Laws
IC laws exist within the story and cannot reference OOC rules.
6.2 — OOC Rules
OOC rules exist for real-world protection and cannot be debated IC.
6.3 — NIA Bridge
NIA may intervene IC only when required to address OOC violations affecting RP.
7.1 — NIA Oversight
The NIA maintains:
• Economy stability
• Anti-cheat enforcement
• Audits
• Laws, elections, and global systems until population supports decentralization
7.2 — Roleplay Government
Mayor’s Office, DOJ, PD, and EMS operate strictly within RP.
Leaders may be appointed by NIA until elections are viable.
8.1 — Server Rules
• No cheating or exploits
• No macro automation
• No metagaming or powergaming
• Respect NLR
• No harassment
• No hate speech
• No ERP
• No RMT
• Follow staff instructions immediately
9.1 — Hold Harmless
You agree to hold owners and staff harmless from claims or damages arising from participation.
9.2 — No Warranty
All services are provided as-is with no guarantee of uptime, data integrity, or continuity.
9.3 — Indemnity
You agree to defend and indemnify the project if your actions cause legal or financial harm.
9.4 — Jurisdiction
Any disputes fall under the governing law specified in the Terms of Service.
10.1 — Purpose
Montaro enforces accountability through a structured, transparent tiered ban system.
Quality and safety take priority over speed.
10.2 — Zero-Tolerance
The following result in immediate, permanent, irreversible removal:
• Severe harassment or hate speech
• Sexual content or ERP
• Any real-world money transactions
• Doxxing or stalking
• Threats of violence
• Predator behavior or child-related content
10.3 — Sanctions
Staff may not downgrade Zero-Tolerance offenses.
Warnings, suspensions, and bans escalate based on severity and repeat behavior.
Terms Of Service (TOS)
By accessing or participating in the State of Montaro (including the FiveM server, Discord, website, or any affiliated platform), you agree to these Terms of Service.
If you do not agree, you must discontinue participation immediately.
The State of Montaro is a fictional entertainment environment. Nothing within the project constitutes legal, financial, or personal advice. Participation does not grant ownership, authority, or any rights beyond those explicitly stated in these Terms.Participation in the State of Montaro is limited to individuals who meet the following criteria:
2.1 Age Requirement
You must be 18 years of age or older to participate in any State of Montaro platform, including Discord and the FiveM server.
2.2 Voluntary Participation
All involvement in the project is voluntary. Nothing within the State of Montaro creates employment, partnership, or contractual obligation of any kind between you and the project staff, ownership, or NIA administration.
2.3 Content & Recording Consent
By joining, you grant the project permission to record, stream, capture, or rebroadcast your gameplay, voice, text, and interactions for content creation or promotional purposes. This license is perpetual, worldwide, royalty-free, and irrevocable.
2.4 Platform Access
Your access to the FiveM server, Discord, or website may be revoked at any time if you violate these Terms, community rules, or pose a safety risk to other participants.
2.5 Compliance Requirement
By participating, you agree to abide by all Terms of Service, Community Rules, and administrative directives issued by the National Investigation Agency (NIA).
3.1 General Conduct
You agree to behave respectfully, responsibly, and without causing harm to the community, its members, or its infrastructure. Toxicity, harassment, discrimination, or targeted abuse is strictly prohibited.
3.2 No Cheating or Exploits
You may not use cheats, macros, automation tools, exploits, glitches, or unauthorized third-party software to gain advantage in the State of Montaro. Exploiting unintended mechanics is a bannable offense.
3.3 Out-of-Character (OOC) Behavior
OOC behavior must remain separate from in-character (IC) actions. Harassment, threats, or inappropriate communication—whether IC or OOC—may result in removal from the community.
3.4 Protection of Personal Information
You may not share your own or anyone else’s personal information. Doxxing, data gathering, or privacy violations will result in immediate permanent removal.
3.5 Respect for Administrative Decisions
All participants must comply with directions issued by the National Investigation Agency (NIA). Administrative decisions are final unless formally amended under the procedures in Section 13.
3.6 Reporting Responsibilities
Users are encouraged to report serious violations, safety concerns, or harmful behavior to NIA staff. Abuse of the reporting system may itself constitute a violation.
3.7 Intellectual Property & Creative Rights
All characters, assets, and stories you create inside the State of Montaro remain part of the project’s shared fictional universe. You grant the project a perpetual, royalty-free license to utilize these creations for gameplay, media, and promotional purposes.
4.1 Account Responsibility
You are fully responsible for maintaining the security of your accounts on all platforms associated with the State of Montaro, including Discord, FiveM, and any linked services. Sharing accounts or allowing unauthorized access is strictly prohibited.
4.2 Password & Device Security
You must take reasonable steps to secure your devices, passwords, and authentication methods. Compromised accounts resulting in harm to the community may lead to suspension or permanent removal regardless of intent.
4.3 Unauthorized Access
Attempting to access another user’s account, server files, staff tools, or administrative systems without permission is strictly prohibited and will result in immediate removal.
4.4 Impersonation
You may not impersonate staff, NIA members, server ownership, or any official representative. Misrepresentation for personal gain or influence is grounds for a permanent ban.
4.5 Account Ownership
All accounts and characters used in the State of Montaro exist within the project ecosystem. Users do not possess ownership rights over in-game identities, items, or currency.
4.6 Lost Access
If you lose access to a Discord or FiveM account, NIA staff may assist with verification but cannot guarantee restoration of items, roles, characters, or progress.
5.1 Cheating & Exploits
You may not use cheats, macros, dupes, automation tools, or any exploit of server mechanics. Exploiting or intentionally triggering bugs for advantage results in removal.
5.2 Real-World Money Transactions (RMT)
Absolutely no exchange of real currency, crypto, goods, or services for in-game value is allowed.
This includes:
• Selling in-game items or currency
• Selling characters, businesses, or positions
• Selling priority, access, or whitelists
• Paying for in-game services
Any RMT violation is a permanent, irreversible ban.
5.3 Harassment & Abuse
You may not threaten, harass, stalk, demean, or target another player. Both IC and OOC harassment are violations. Persistent negativity or intimidation is treated as abuse.
5.4 Doxxing & Privacy Violations
Releasing or seeking personal information about any player or staff member results in immediate permanent removal.
5.5 Unauthorized Modifications
Users may not modify, decrypt, or interfere with any server files, assets, anticheat systems, or backend tools.
5.6 Impersonation & Fraud
You may not impersonate staff, NIA, PD, DOJ, or any position of authority.
You may not mislead players for financial or strategic advantage.
5.7 Disruptive Behavior
Actions intended to harm the community environment—including trolling, griefing, scene disruption, or intentionally wasting other players’ time—are violations.
5.8 ERP (Erotic Roleplay)
No erotic, sexual, or suggestive content of any kind may be performed, written, implied, or referenced in any State of Montaro platform. This is a zero-tolerance rule.
5.9 Unauthorized Recording
Recording or streaming is allowed, but secretly recording private conversations with the intent to intimidate, expose, or manipulate is prohibited and subject to disciplinary action.6.1 Ownership of Project Assets
All logos, scripts, textures, mechanics, branding, storylines, and worldbuilding elements belonging to the State of Montaro are the exclusive property of the project’s owners. Users obtain no ownership rights by participating in the community.
6.2 User-Generated Content (UGC)
Any character, storyline, dialogue, design, or creative contribution you make within the State of Montaro becomes part of the shared project universe.
You grant the project a perpetual, worldwide, royalty-free license to:
• Record your gameplay
• Rebroadcast your voice, text, or actions
• Use clips, screenshots, and character likeness
• Adapt your contributions for storytelling, media, or promotional content
6.3 Content Removal
The project may remove any user-created content from the platforms at any time for reasons including:
• Violating the rules
• Endangering the community
• Conflicting with lore or server direction
• Legal or safety concerns
6.4 Third-Party Rights
You may not upload or distribute copyrighted or proprietary material that you do not have the rights to.
Examples:
• Music you didn’t create or license
• Artwork pulled from the internet
• Paid scripts or MLOs you do not own
• AI-generated replicas of copyrighted works
6.5 Creator Rights Disclaimer
Creating content inside Montaro (streaming, YouTube, TikTok, etc.) is permitted and encouraged.
However:
• You may not claim ownership over the world or its mechanics.
• You may not attempt to monetize in-game items, perks, or positions.
• You must comply with all platform-specific community guidelines.
7.1 Service Availability
The State of Montaro is provided “as-is” and “as-available.”
Server uptime, stability, or feature availability is not guaranteed.
Unexpected downtime, wipes, rollbacks, or resets may occur without warning.
7.2 Data Integrity
The project is not responsible for loss of:
• Characters
• Items
• Vehicles
• Currency
• Property
• Progress
• Businesses
due to crashes, resets, bugs, or external platform issues.
While reasonable effort is made to protect data, full preservation cannot be guaranteed.
7.3 Platform Access Rights
Access to the FiveM server, Discord, website, or any affiliated system is a privilege—not a right.
NIA reserves the authority to:
• Suspend access
• Limit access
• Remove access
for violations of rules, safety concerns, or community protection.
7.4 Account Suspension & Removal
If you are banned or removed from the community:
• You lose access to all characters, assets, and progress.
• You are not entitled to restoration or reimbursement.
• Appeals may be offered only at NIA discretion.
7.5 Data Collection
Participation in Montaro may involve logged data, including:
• Gameplay activity
• Chat logs
• Voice proximity logs
• Administrative interactions
• Punishments and warnings
• IP logs for security
This data is used solely for safety, anti-cheat, moderation, and project improvement.
7.6 Privacy Limitations
Although the project respects user privacy, absolute confidentiality cannot be guaranteed if:
• Required to protect the community
• Necessary for disciplinary action
• Required by law enforcement
• Needed to resolve disputes or appeals
7.7 Third-Party Services
Montaro relies on external services (Discord, FiveM, Tebex, etc.).
Users must comply with those platforms’ Terms of Service in addition to Montaro’s.
Violations on external platforms can result in in-city consequences.
8.1 General Disclaimer
The State of Montaro, its owners, administrators, and affiliates provide all services, platforms, and content “as-is” and “as-available.”
No warranties of any kind—express or implied—are offered.
8.2 No Guarantee of Performance
The project does not guarantee:
• Continuous or uninterrupted service
• Bug-free gameplay
• Stability or performance
• Preservation of data or progress
• Availability of specific features, jobs, systems, or events
Features may be added, removed, paused, or redesigned at any time.
8.3 No Legal or Financial Responsibility
Nothing provided within the State of Montaro constitutes:
• Legal advice
• Financial advice
• Real-world professional guidance
All in-game mechanics, features, and narratives are fictional and for entertainment only.
8.4 User Responsibility
Users assume full responsibility for:
• Their account security
• Their interactions
• Their hardware and software setup
• Any data loss resulting from crashes or resets
Participation is at the user’s own risk.
8.5 External Dependencies
The project relies on third-party services such as Discord, FiveM, and hosting providers.
The project is not responsible for failures or outages caused by these platforms.
9.1 Scope of Limitation
To the fullest extent permitted by law, the State of Montaro, its owners, staff, administrators, and affiliates shall not be liable for any damages, losses, or claims arising from your participation in the community or use of any of its platforms.
This includes, without limitation:
• Loss of characters, items, or currency
• Loss of progress or property
• Downtime or server resets
• Bans, suspensions, or administrative actions
• Exposure to player-created content
• In-game interactions, conflicts, or story outcomes
• Unauthorized access due to compromised user accounts
Participation is voluntary and at your own risk.
9.2 No Responsibility for User Behavior
The project is not liable for:
• The conduct, statements, or actions of other users
• In-character or out-of-character conflicts
• User-generated content, speech, or roleplay
All community members are responsible for their own behavior.
9.3 Indirect and Consequential Damages
Under no circumstances shall the project be liable for:
• Lost profits
• Emotional distress
• Real-life financial losses
• Real-life business losses
• Reputational harm
• Any other indirect or consequential damages
This applies regardless of whether such damages were foreseeable.
9.4 Hold Harmless Agreement
By using any Montaro platform, you agree to hold harmless and indemnify the project, ownership, and staff from any legal claims, disputes, or damages arising from:
• Your actions
• Your gameplay
• Your content
• Your violations of rules
• Your interactions with others
You further agree that participation creates no contract, employment, partnership, or fiduciary relationship.
10.1 Right to Terminate
The State of Montaro reserves the right to suspend, restrict, or permanently terminate a user’s access to any platform (FiveM server, Discord, website, or related services) at any time, for any reason, with or without prior notice.
10.2 Grounds for Immediate Suspension or Ban
Actions resulting in instant termination include:
• Cheating or exploiting
• Real Money Transactions (RMT)
• Doxxing or sharing personal information
• Harassment, threats, or hate-based behavior
• ERP or sexual content involving any user
• Attempted access to staff tools or administrative systems
• Targeting the server, staff, or community with malicious intent
These actions are considered zero-tolerance violations and are not eligible for appeal.
10.3 Progressive Discipline
For non–zero-tolerance violations, NIA may apply escalating enforcement steps:
• Verbal or written warning
• Temporary suspension
• Economy or property resets
• Business or gang license removal
• Long-term suspension
• Permanent ban
Discipline is at staff discretion and based on context, history, and severity.
10.4 Appeals
Appeals for non–zero-tolerance bans may be submitted through official channels (Discord ticket or website form).
NIA reserves the right to:
• Accept or deny appeals
• Request additional evidence
• Close an appeal without discussion
Zero-tolerance bans cannot be appealed.
10.5 Staff Authority
NIA staff retain full authority to:
• Remove disruptive players
• Reverse or modify enforcement actions
• Take emergency action during crisis events
• Protect the community from harmful behavior
All enforcement decisions are final unless formally overturned by senior NIA administration.
10.6 Data & Property on Termination
Upon termination (temporary or permanent):
• All characters, items, vehicles, currency, properties, and progress may be revoked
• Access to any related platform is removed
• No refunds, restorations, or reimbursements are provided
Users waive any ownership claims to in-game assets following removal.
11.1 Internal Resolution First
All disputes related to gameplay, enforcement actions, staff decisions, or community conduct must be handled internally through NIA support channels (Discord tickets, website forms, or designated administrative contact points).
Players may not escalate disputes publicly, incite conflict, or attempt to rally others against staff decisions.
11.2 Evidence Requirements
All disputes must be supported with evidence, which may include:
• Screenshots
• Video clips
• Chat logs
• Relevant timestamps
• Server logs (retrieved by staff only)
False reports or intentionally misleading evidence may result in disciplinary action.
11.3 Administrative Review
NIA staff will review all disputes in good faith.
Resolutions may include:
• Clarification or education on rules
• Reversal or modification of penalties
• Mediation between parties
• Dismissal of the dispute
All decisions made through administrative review are final.
11.4 External Disputes
Users agree not to pursue external resolution (legal, financial, or platform escalations) for matters related to:
• In-game actions
• Lost items or progress
• Staff decisions
• Bans, suspensions, or removals
• Community conflicts
• Roleplay outcomes
Participation in the State of Montaro constitutes acceptance of internal dispute resolution as the exclusive method.
11.5 No Collective Action
Users waive the right to:
• Join class-action efforts
• Organize group complaints
• Coordinate pressure campaigns against staff or the project
All disputes must be handled individually.
11.6 Finality of Decision
After administrative review concludes:
• The matter is considered closed
• Further argument or escalation is not permitted
• Subsequent violations may result in sanctions
12.1 Authority to Amend
The National Investigation Agency (NIA) holds exclusive authority to modify, revise, or expand this Terms of Service and all associated policies. Amendments may occur at any time to preserve security, balance, and community integrity.
12.2 Amendment Categories
Amendments fall into three classes:
• Minor Amendments
Grammar fixes, clarifications, or non-substantive organizational updates.
• Standard Amendments
Rule changes, added policies, new definitions, or adjustments to enforcement procedures.
• Major Amendments
System-wide changes, structural governance updates, monetization rules, or legal disclaimers.
12.3 Notice of Changes
All amendments will be posted in at least one official location:
• Website (stateofmontaro.com)
• Discord Announcements Channel
• Patch Notes or Update Logs
Players are responsible for staying informed.
12.4 Effective Date
Unless otherwise stated:
• Minor amendments take effect immediately.
• Standard and major amendments take effect after public posting and timestamping.
12.5 Continued Participation as Consent
Continued use of any State of Montaro platform, service, or game server after an amendment is posted constitutes acceptance of the updated terms.
12.6 Archive of Changes
NIA will maintain a change log containing:
• Amendment date
• Summary of changes
• Version number increase
• Notes on impact (if applicable)
This archive may be made publicly viewable for transparency.
12.7 Temporary Rules
During critical updates, emergencies, exploits, or beta-phase changes, NIA may issue temporary rules that override prior terms. These remain in effect until revoked or formally incorporated.
13.1 Agreement to Terms
By joining, accessing, or participating in any State of Montaro platform (including Discord, the website, FiveM server, or affiliated media), you agree that you have read, understood, and accepted all policies contained within this Terms of Service.
13.2 Binding Effect
These terms constitute a binding agreement between you and the State of Montaro administrative body (NIA). Your participation serves as full acknowledgement and acceptance of every section, including all future amendments.
13.3 Responsibility to Stay Informed
You are responsible for keeping up to date with:
• Rule changes
• Amendments
• Announcements
• Enforcement updates
These will always be posted through official channels.
13.4 Consent to Enforcement
By participating, you consent to:
• Investigations
• Administrative actions
• Audits
• Log reviews
• Sanctions as described within this document
Refusal to comply with staff direction results in immediate removal from all platforms.
13.5 No Claims or Ownership
You acknowledge that:
• All in-game items, currency, assets, and characters are non-transferable and have no monetary or ownership value.
• You have no legal claim to server files, community content, or administrative decisions.
• Participation is a privilege, not a right.
13.6 Final Authority
The National Investigation Agency (NIA) reserves final, undisputed authority over:
• Interpretation of rules
• Application of enforcement
• Resolution of disputes
• Admission and removal of community members
13.7 Leaving the Community
You may leave at any time. Upon departure:
• You waive all future claims related to gameplay, characters, items, or contributions.
• You accept that banned or removed accounts are not eligible for appeal unless explicitly allowed by NIA.
13.8 Continued Participation as Acceptance
Ongoing use of State of Montaro services constitutes continuous acceptance of:
• All rules
• All updates
• All enforcement actions
• All terms within this agreement
If you do not agree with any part of this document, you must discontinue participation immediately.
